Malcolm Benge advises foreign and domestic clients on a wide range of aviation-related matters. His practice involves frequent participation in proceedings before the Department of Transportation and the Federal Aviation Administration. Areas of specialization include regulation and licensing of commercial airline operations, aviation issues related to mergers and acquisitions, airport privatization initiatives and aircraft parts certification matters. Mr. Benge also has extensive experience in the negotiation and documentation of airline commercial agreements and aircraft transactions.
Representative matters handled by Mr. Benge include a comprehensive review of regulatory compliance at a major U.S. airline, advice to a multinational private equity fund regarding citizenship requirements for U.S. air carrier ownership, the purchase and export of special purpose aircraft subject to U.S. trade restrictions and a loan financing secured with airport slots as collateral. Mr. Benge also has represented clients before the General Accountability Office and the Armed Services Board of Contract Appeals in connection with government contracts matters.
